Under NCRA CLVS guidelines, the videographer must remain on the record until all counsel agree to go off the record. Stopping or pausing without unanimous consent violates protocol, and the deponent does not have the authority to dictate the record.

The 3-to-1 rule dictates that the distance between two microphones should be at least three times the distance from each microphone to its intended sound source to prevent acoustic phase cancellation. Using a single omnidirectional mic reduces audio isolation, and filters or volume adjustments do not resolve acoustic phasing.

FRCP 30(b)(5)(A) requires the officer recording the deposition to begin with an on-the-record statement that includes the officer’s name and business address, date, time, place, deponent’s name, and the administration of the oath. Stating SSNs, testimony summaries, or estimated durations is inappropriate and not required.

A CLVS must maintain a neutral, objective head-and-shoulders frame (bust shot) of the deponent and should not alter framing to emphasize gestures unless agreed upon by all counsel on the record. Panning dynamically compromises objectivity, and instructing the deponent interferes with their natural testimony.

Closing the blinds and using controlled, artificial lighting ensures a properly exposed, professional image of the deponent without background distraction. Relying on auto-iris or overexposing the subject against a bright window results in a silhouetted deponent or a blown-out background, and shooting in profile violates standard framing rules.

The CLVS must act as an impartial officer of the court and cannot use camera techniques (like extreme close-ups) to prejudice the viewer or emphasize a deponent’s demeanor. Complying with the hiring attorney’s request violates this fundamental ethical duty of neutrality.

A 60Hz hum is typically caused by a ground loop, which occurs when interconnected equipment is plugged into different circuits with varying ground potentials. Increasing gain only amplifies the hum, and phantom power is irrelevant unless using condenser microphones.

Video deposition edits must strictly adhere to attorney designations and court rulings, maintaining the exact context and timing of the original testimony. Adding transitions, altering pauses, or artificially enhancing the audio manipulates the evidence and violates CLVS standards.

In legal video, ‘synchronization’ specifically refers to the process of linking the video file to the court reporter’s certified ASCII transcript, allowing attorneys to search text and instantly play the corresponding video clip. It does not refer to multi-cam alignment, basic A/V sync, or file compression.

The videographer is an impartial observer and must never provide legal advice, procedural instructions, or non-verbal cues to the deponent. The video must continue rolling during objections unless all counsel explicitly agree to go off the record.

CLVS standards mandate a completely independent audio backup system to ensure the preservation of the record in case the primary camera or mixer fails. Relying on the court reporter or a low-quality built-in camera mic does not meet professional redundancy standards.

The videographer is responsible for the quality of the A/V record and should politely interrupt on the record to inform counsel of severe technical issues like noise interference. Stopping the record unilaterally or ignoring the problem compromises the integrity of the final product.

Mixed lighting creates color temperature conflicts; a manual white balance ensures the camera accurately renders colors (especially skin tones) based on the exact light hitting the subject. Auto White Balance can shift distractingly during recording, and standard presets will not accurately correct for mixed lighting.

The court reporter is typically the authorized officer (often a notary public) who administers the oath to the deponent. While a videographer can administer the oath if they are a notary and authorized in that jurisdiction, attorneys cannot swear in witnesses.

The CLVS is the custodian of the video record and must retain the original master media to ensure chain of custody, prevent tampering, and provide an impartial record. Giving the master media to any party, even the hiring attorney, violates this ethical obligation.

When using PIP for digital exhibits, the primary visual record of the deponent’s demeanor (their face and shoulders) must remain clearly visible and unobstructed. Covering the deponent undermines the fundamental purpose of the video deposition.

MPEG-4 (MP4) is the modern industry standard for legal video delivery due to its high visual quality, manageable file size, and universal compatibility with trial presentation software like TrialDirector and Sanction. Uncompressed AVI files are impractically large, and VHS/FLV are obsolete.

The NCRA CLVS Code of Ethics and professional guidelines require videographers to maintain a professional appearance (business attire) at all times, reflecting their role as impartial officers of the court, regardless of a specific firm’s relaxed dress code.

A videographer must not intentionally manipulate audio levels to capture private, potentially privileged conversations between a deponent and their counsel. However, muting the mics entirely risks missing sudden on-the-record testimony, so levels should simply remain steady.

FRCP 30(b)(5)(C) requires that at the end of a deposition, the officer must state on the record that the deposition is complete and must set forth any stipulations made by counsel. Abruptly stopping the recording without a formal, spoken sign-off violates this rule.
